Can I add this to my real estate contract to protect myself being sued?
I am selling a property. Can I add a clause that " Any fees or costs incurred in connection with mediation proceedings shall be paid in equal shares the parties(buyer and seller)".

Sure, that is anyway the standard procedure in mediations ["shares BY the "; you dropped the word "by"]. be sure y have a clause that the parties have to go to mediation, but since the matter only is settled if both parties agree, it is a waste of time if it is clear one party will not settle. You cna not avoid suit but you can lessen the costs.
