Follow Mr. Whipple's advice.

In Bakersfield, where I have my practice, a knowledgeable and friendly clerk can you help you immensely.

Be sure to comprehend that the clerks cannot give legal advice (and signs plus the clerks will tell you), but they are very helpful with procedural matters. Your situation is much more procedural, than legal.

Re: add spouse to property

If it is your spouse, then there should be no additional tax because she is already legally 1/2 owner of the property. Just remember to refile your new deed as 'a married couple with rights of survivorship'.

If you need assistance, our office can do so for a minimal charge. Pleae feel free to contact me at the phone, email and address provided by LawGuru or through our firm's website, No-Probate.com.

Under state law, it shouldn't, but each county seems to have procedural differences as to how you call the assessor's attention to the fact that yours is an exempt transfer, so I always advise asking a knowledgable clerk at both the recorder's office and the assessor's office what local procedures are needed to assure you are not accidentally reappraised.
