Legal Question in Real Estate Law in California

Hello, Thanks in advance for answering my question. My husband and I lost a home a couple of years back or so we thought. We never were given paperwork about foreclosure and our credit reports do not have any indication of one. We recently received documentation from a bank that may have bought our loan notifying us that the loan has been paid in full and the trust deed was also included. This loan is from 2008. We moved to California and a relative took over residence and agreed to pay the monthly to try and help us keep the house while we persued employment t opportunities in Ca. We have talked to the bank and they said it looks like everything is legit on their end and they do not know why we are being notified only now about the loan status. We checked with a title company here in ca that said the same thing. We are asking legally can we persue getting this house back? I believe it went to auction by the lender then and it seems that the same investor has had trouble with recordings and such and could not sell it probably because of title issues but is in possession of the property until now and still cannot sell it. What are our rights in this matter is this worth persuing in your oppion? Thanks again for any insight you can give us.

Best Regards,

Rebecca

1 Answer from Attorneys

While it is not entirely clear from your question, it sounds like you are in CA and the property is in another state. If that is correct, you need to repost your question using the state the property is in, because that is the law that will govern your rights and options. Even if you get your question up in the right state, though, ultimately you are going to have to sit down with an attorney and go over the facts, details, timeline and documents in order to sort out whether you still have any right to the property. Land title issues are too complicated to deal with in an internet Q&A forum.
