Legal Question in Real Estate Law in California

Adverse Possession of my property

There is a block wall between my property and my neighbors. I belive there is 2 feet of my property on there side of the wall(as per trac map). I don't want to give up ownership of this land. My neighbors have been maintaing it as there own for over 4 years I have lived here three years. I feel they are trying to gain ownership by maintaining the fact that they are maintaining the property. I want to stop the prosess of them acquiring the land by adverse posession. We are on frendly terms I dont have any problem with them using the propeerty, I just don't want to loose the property line. This is important because of the setback requirments required down the road if I decide to add on to my house. Do they have to file leagle documents to aquire this land? What is the time frame? Did any county department have to notify me if this process was started leagly I mean my neighbors filing a notice of intent or to pay taxed on my land?

Thank you

Re: Adverse Possession of my property

You need to immediatly file a trespass lawsuit to protect you interest. You may be on friendly terms, however it is clear that your neighbors will be able to acquire you land by adverse possession within 5 years of the original trespass. Call me at 818-342-8020 for a free consultation if you are in Southern California.
