Legal Question in Real Estate Law in California

I need advice please

I'm a few payments behind with my

house monthly pymt. I want to

negotiate with the bank in order to

keep the house. I hired a company to

help me with it and gave them

$1,500 up front. The last check I

gave them unfortunately bounced

because I was about $100 short in

the bank. Someone from their office

called me very upset. I explain to her

what had happened and told her I

was very sorry. She threatened me

to stop my case and asked me for

more money than we had agrred on.

I don't have all the money they now

want. Is it posible for me to negotiate

with the Bank?. I don't want to loose

my house. What worries me is that

these people might try to do

something to affect me with the

Bank, they also have my paperwork

and I'm afraid they might not give it

to me. What can I do?. Are banks

willing o negotiate directly with the

person with the loan?. Please advise

me. How do I need to approach the

bank?.

I just answered this question for another individual. You absolutely can go directly to the bank and negotiate the loan modification yourself. Call them today and see what they need to start the process. If you now have the other $100 to pay the current company that was working on the modification, then they may be able to help you. I would ask them what they have already done for the money you have paid them, however.

The state attorney general's office is being swamped with companies who are taking people's money and not going anything for it (many scams out there). Before you pay anything further, you may want to check out the compay with the Better Business Bureau and the State Attorney General's office to see if consumers have lodged complaints against the company (or simply google their name and see if they have been the subject of probes, news articles, etc). If so, try getting back your money through one of these consumer advocates on local tv or radio stations, and negotiate with the lender itself.
