Legal Question in Real Estate Law in California

Is it alright/legal for me to rent my house out when I have filed bankruptcy and have not made a payment on my house in over a year. For medical reasons I have moved out of the house(still own it) and have moved in with my mother. The bank has not " bothered me."

It is perfectly legal for you to rent any property you own, subject to your bankruptcy situation. Depending on whether you have completed the bankruptcy, and what chapter you filed under, the Trustee may have claim on the rents. If you were in a Chapter 7 and the discharge has been entered and the case closed, you have no legal problem. Any other Chapter, and/or the case not done, and you would need to talk to a bankruptcy attorney about what your obligations are to notify the trustee, etc.
