Legal Question in Real Estate Law in California
Thank you Anthony Roach & Mr. Whipple. I can't figure out how to attach 4 photos! I climbed a ladder & tried to show how the cyclone fence on my neighbor's side is parallel to the wood fence on my side. I cannot afford a surveyor either, but that is likely the best eventual course, to ensure the correct property line & whether the wood fence is a "boundary" fence. I tried to discuss it with the neighbor Monday evening, however, she is still having the "fence co." out to give an estimate. I intend to repair the center section of the fence and replace the post. When I went to check it Monday & take the photos, it appears someone from the neighbor's side has intentionally tried to push the fence down. A section in the center, where I will repair it, has been pushed over somewhat. It was never like that until now. Short of a survey, if we both have existing fences, does that mean we each maintain our own, or am I responsible to pay for 1/2 of a new fence? I didn't think the law could force me to replace it all if I can repair the bad section. I also didn't think the law would force me to accept a company and their cost estimate just because it's the company my neighbor wants to use. Any additional advice?
