Legal Question in Real Estate Law in California

Apartment building is up for sell

The apartment building I live in has been for sale for two years. Every month or so, the agent representing the owners notifies the tenents the prospective buyers plus various inspector are looking at the property. The RE agent has generally given us 24 hours or less hour notice. What are our legal rights?

Thanks!

Re: Apartment building is up for sell

You are entitled by law to 'reasonable notice.' The law says 24 hours' notice is reasonable. Whether shorter notice is reasonable depends on the facts. If you were frequently getting only 8 to 12 hours' notice, I'd say that was unreasonable. If you got notice at noon Tuesday that someone was coming to look briefly at 10:30 a.m. on Wednesday, I think that might be considered reasonable.

In your case, the cumulative effect of repeated visits over a year might amount to an unreasonable situation. If you are otherwise happy with the tenancy, it might not be worthwhile to make a formal or legal complaint even if you do have a theoretical case. I suggest firmly but politely informing the management that the tenants are becoming irritated and would appreciate more concern for their privacy. You need dialogue more than litigation. Good apartments are scarce.
