Legal Question in Real Estate Law in California

Apartment Rental

I have been sued by my apartment complex recently for $4700 for not paying rent for 8 months at a rate of $595 per month. They sent us a copy of the rental agreement and where it says the rent amount per month there's a typo but it's very clearly typed as stated : Rent: Rent is due in advance on the 5th day of each month, at $40.00 per month, beginning on april 1st 2008. Basically, I just wanted to know if I should go to court and fight the amount because of the paperwork that was filled out?

Re: Apartment Rental

Unfortunately judges in landlord-tenant court are humorless folks who are so used to ruling against tenants that any given tenant could well lose, probably will lose, despite the best of legal arguments. You have only five days after you were served to respond to the lawsuit. Maybe you can find a lawyer or legal clinic in your area who can have fun with the situation, I know I would. Read caltenantlaw.com and run your situation by the lawyer who runs that site.
