Legal Question in Real Estate Law in California

Was in an automobile accident mar 15 2012. It was the other motorist fault ran a red light. I had the motorist sign avidavit he was at fault. He fixed my car on the grounds i dont report it. Got my car back not in good condition went to dealership they said cost would be 7000 dollars. Should i still go through insurance or will they not pay because he worked on it. Or should i go to small claims court?

Since he did not fix your car the way you assumed he would, he has breached your agreement with you. Report the accident to your insurance company and let them worry about collecting from him. Remember that you are entitled to payment for the use of a rental vehicle, whether or not you have to use one. It is difficult, but depending on the age and prior condition of the vehicle, you might get a few hundred more for diminished value [must make a very logical argument to them]
