Legal Question in Real Estate Law in California

Here is the background

I purchased trust deed with 7 other investors through company-A

the property was taken back by the investors through foreclosure and then resold

The buyer is now suing Company-A and the investors for breach of contract.

The Buyer is suing Company-A and the 6 other investors. The 7th investor (ME) is not listed as a defendant. I believe this was oversight.

What should i do? I have already paid my portion of the retainer fee to Company-A's lawyer to defend us.

- since I am not a defendant i could ask for my retainer back but

but i can also still be sued separately at a later time

It sounds like an oversight. You could be named later, if you have already retained an attorney, you should raise this question with the attorney you've already hired.
