Legal Question in Real Estate Law in California
My balcony during the rain period start leaks thru, I am leaving on the 3-rd floor. Me and my neighbor notified HOA for this issue, received letter from HOA, that is not HOA responsobility. I try to prevent bigger damage and sealed the balcony with penetration sealant, it did not help.
Rules and Regulation on other way says:
The Association ( not individual Owners) is solely responsible for maintaining and repairing the following specific items if they exist on the Property:
1). �..

3)�..
4). Finished surfaces and structural and waterproofing components of balconies, balcony railings, patios, storage spaces, parking spaces, and /or garages.
Please advise what to do? And who is responsible?

Can you attend an HOA meeting and point out the obvious discrepancy between their letter and Item #4? If not, write them another letter. If that fails, have an attorney write a letter.
