Legal Question in Real Estate Law in California
Bathroom under construction
The shower drain in my bathroom is broken, water
drips into my downstairs neighbors apartment causing
her ceiling to come down. My landlady is having my
shower fixed which makes it impossible for me to use
my shower for approximately 6 days. (It takes the
plumber one day (Monday) to replace pipes and drain,
the tiler will need four to five days meaning that he will
probably work on Saturday--my day off. On
Monday--President's Day, my other day off--the painters
will come to repaint the bathroom since that was never
done before I moved in two years ago.
While I appreciate that everything is being fixed, I find it
still unacceptable that I am not able to use my shower
and that I have to spend my days off somewhere else
than in my apartment.
Is my landlady responsible to compensate me for a
hotel, or to reduce my rent?

Re: Bathroom under construction
you may have the right for rent abatement for the 6 day period that you will be unable to use your premises, but i would need more facts on the matter. but, yes, from the facts given so far, you should be entitled to recover any out of pocket expenses you may incur while you are unable to use your premises during the construction period.
