Legal Question in Real Estate Law in California

How to break a lease

My husband and I would like to know how to break a year lease with our apartment complex. We wuld like to do it with little out of pocket expense as possible. we have only been renting for three weeks. The apartment complex is too loud . Due to my husbands work schedule he has to wake up early in the morning and he goes to bed at 8:30pm . There are too many kids running around at that time . Please reply ASAP.

Re: How to break a lease

from the facts given so far, u appear to have causes of action for nuisance, breach of contract as an intended third party beneficiary, and/or breach of covenant of quiet use and enjoyment of your premises. this may all add up to constructive eviction in which you may be able to "break" the lease if you move out and/or recover damages. if you can email my law firm more detailed information we can better advise you of your legal rights and/or offer your representation.
