Legal Question in Real Estate Law in California

Breaking a Lease

I am going to break a lease with a roommate that has become very abusive physically. I am told that even though I signed a one year lease I will still held responsible for the remainder of my sggreement. I have tried to get my roommate to sign a rental release agreement to no avail. Do I have any rights to break my lease because of the abuse. Also I have been paying for all the utilities that were verbally agreed upon to split 50/50. One last question can I be sued by either roommate or landlord if I move out?

Re: Breaking a Lease

If you leave the landlord can sue you for any unpaid rent or damages to the property.

You may want to consider a domestic violence restraining order. You said that there was abuse by the person that you are living with. This qualifies for a domestic violence restraining order.
