Legal Question in Real Estate Law in California

Breaking a lease

Hi there,

I have a lease until the november of this year. We are

breaking it to move to another state because my

husband got a new job. The property manager told me

that their penalty is that we pay an extra months' rent.

However, she also told me that they have already found

anothe tenant to fill the apartment. So would I still owe

them money? I have already given 30 days notice.

Thanks!!

Re: Breaking a lease

They cannot charge for the same unit twice. However, they can charge you for a pro-rated amount for the cost of re-renting the property, and if there is more than one apartment available for rent, they might be able to argue that the other vacant one would have been taken if yours was not available.
