bring them to negotiate

if im in a suit with someone, how can i bring them to negotiate. how can i know if they are willing to negotiiate. my lawyer does not tell me if they are willing to settle. can i call the opposing lawyer myself?

im pretty sure i have a great case and should be in negotiations by now.

please advise

First, I would recommend that you insist on better communications with your attorney. He or she works for you. You pay the bills, you get to call some of the shots.

Next, your lawyer has a duty to inform you of any and all settlement offers made by the other side.

If your case is so great, why not just hang in there and see what the jury (or judge) gives you? Just kidding. I am a big advocate of negotiated settlements.

Settling lawsuits is a big high-stakes poker game, and the other side usually doesn't want to send clear surrender signals, at least early in the case. Have you been to mediation? This is often an opportunity to open up settlement talks without showing weakness.

Again, the starting point is to have a discussion with your lawyer about you side's settlement tactics and overall strategy. Your lawyer may have a clear plan that's well thought out and to your advantage, but also possibly may have no idea what you're thinking or what's best for your outcome.
