Legal Question in Real Estate Law in California

My brother and I inherited our parents home over 10 years ago! we both have one half ownership and we split the tax and insurance cost! He lives in the home and paid me a small rent! abouut 18 months ago he lost his job and has refused to pay any rent! I am in need of funds to live on and would like to sell the house! He will not agree to sell! What are my legal options?

I am guessing that you two own the property as Joint Tenants. You ask the court for a judicial sale partition. This will force a sale of the property and for both of you to share the profits.

Your only option if he will not agree to sell is an action for partition.
