Legal Question in Real Estate Law in California

Change name on Real Property Title

Hi,

I purchased a house a few years ago. The house was title to a Single Woman and with my name on it.

I just got married recently and changed my last name.

I want to change my title on the property with my currently last name and marital status.

I probably won't add my husband's name on it yet because I don't want to refinance. Is that possible?

Or do I have to refinace to make the Title change?

Thank you very much.

Monic

Re: Change name on Real Property Title

You can record a deed that changes and corrects you name. You are essentially deeding the property to yourself under your new name. See a local attorney for the specifics, but the new deed should reflect title like this: "Jane Smithy, a married woman, as her separate property"

Re: Change name on Real Property Title

I would recommend that before you make any changes to title you get a written agreement from your husband indicating that the property is your separate property and that he claims no interest in it; And that the property will remain your separate property until you agree in writing otherwise.
