Re: Co-councel

This is called "pretexting" and the technique has been much in the news recently because of its use by investigators trying to find the source of reported boardroom information leaks at Hewlett-Packard.

In that case, which is not yet final, I have heard that the prosecutors have not yet indentified any specific law making it illegal. Stay tuned for possible further developments.

If the person who made the call in your case really was an attorney, I'd say that misrepresenting who her or his client was, or was not, is a violation of legal ethics and that he or she would be subject to discipline by the State Bar. If you have a name, go to www.calsb.org and do a member search for the person.
