Collusion and lies
Real estate agt lied in declaration to court about me supposedly not willing to cooperate with showing house for sale. Also said I stink (it was summer & I had been working in garden) and so does the house. She took house OFF mkt one month with pending offer then re-listed it and accepted a new offer from the original buyer @ $20K less. Buyer�s orig agt was excluded from new purchase $. List agt had her colleague present the offer. Now it is considered a dual agency situation. Another prospective buyer came by yesterday. I told him I called him 5 times that I needed to cancel appt. He said he never got msgs. He said, �We are here to see the house, can we go in?� His intonation was so rude, I said, �The ladies can but not you.� He said he was VERY GOOD FRIEND of listing agt & felt compelled to tell her I did not like her. I said to list agt directly, yes, I do NOT like you because you are incompetent and don�t represent our family properly. NO Open House, NO mktg flyers, NO lockbox, NO pictures, NO contact phn# in MLS, NO disclosure that parent DIED in the HOME 2 yrs ago. Isn�t this misrepresentation, illegal and collusion?

I have to agree with Attorney Whipple, there really isn't a question in what you posted. You throw out several legal conclusions, but this forum is really not the place for an attorney to render an opinion about a case such as yours. You need to sit with an attorney, review the specific facts and determine if you have an action or not. Also, if there is a lawsuit pending, you need to retain counsel to defend you. I wish you good luck, but you need substantative legal help, not the kinds of general answers and opinions that are the purpose of this site.

Declaration to court? This dispute must already have resulted in litigation. In that case, you need to hire a lawyer to represent you, not try to get sympathetic but ultimately unhelpful agreement from lawyers on a bulletin board.
