community property

Some friends of mine are starting a real estate business and they were wondering how to keep all of their business from their spouses if they ever got divorced. Would a separate contract between them and their significant others do the trick or would common law prevail in California?

the spouses will own 50% of the business. they might consider a contract allowing them to buy out the spouse and continue the business in the event of divorce.
