For the purposes of Zoning approval is a condo-hotel legally a condominium complex or a hotel? If certain criteria is necessary to satisfy the conditions of a hotel in this situation what would they be?

Re: Condo-Hotel
I would think most municipalities would treat it as both; in other words, it would have to meet the (non-conflicting) requirements applicable to both uses.
Some municipalities in major resort area like Palm Springs or Lake Tahoe may have developed a special zoning classification for condo hotels, but probably very few.
If you are planning to develop or invest in such a project, retain a real estate lawyer who practices in the municipality in question. If you are merely a curious member of the public, a cheaper way to get a pretty reliable answer is to contact the city or county attorney for the municipality and request an opinion.
