Legal Question in Real Estate Law in California

Condoiminum Association Financial Obligations

We live in a condo complex(townhome). The faucet or(turn off valve) for our unit is afixed to the exterior of our building or unit (outside of our patio area). My husband went to turn the H20 off and the knob broke off-we couldnt shut the water off which resulted in a little flooding to our bathroom floor and dining room ceiling. Needless to say we called plumbers and the Association called the restoration company to fix the ceiling (water damage). The Association refuses to pay for any damage. I thought an owner was responsible for the space inside their unit as well as the patio area. I thought anything outside of that is the Association's area. This outside faucet is available to all including their maintenance and gardening folks. The plumber also found a lot of plaster and cememt that had fallen all over the faucet from the exterior surface of our building. If this fixture located in the outside area resulted in damage in the inside of our unit, shouldnt they be paying for it. Every unit has their own faucet in their patio area for their exclusive use and therefore their sole responsibility. How is it we are responsible for the one attached to the outside of the building that is available to anyone. We need help!

Re: Condoiminum Association Financial Obligations

If you understand you need help wire you sitting in front of the computer screen and not in front of a real live human, male or female, attorney at law. You need one who is specialized in both real estate/homeowners associations. There are numerous attorneys in your area with these credentials. It seems part of the should be submitted to insurance carriers. It also seems to you don't have the understanding, knowledge, ability, clout or experience to do this in your own best interest. Therefore, get the real live attorney.I have been practicing law in this legal area for over 30 years and understand your problem well. I practice in the S.F. Bay Area and if you wish to contact me call at 925-945-6000.
