Legal Question in Real Estate Law in California

My dad's house was split 3 ways upon his death. 25% to me 25% to my brother and my ailing mom, divorced from my dad and remarried way before his death, with the other 50%. My brother wants me to buy his 25% out. Who would be responsible for taking action if I can not or won't buy him out? My mom can't buy him out either.

Any one of the parties can force a sale by filing a partition action in court.
