Legal Question in Real Estate Law in California

damages and responsibilities

This is a wierd one. I rent a house, and about 3 weeks ago my neighbors roof was torn off by a gust of wind and landed on our boat. The owners home insurance is now saying they will not cover the damamges done to our property. What should we do? Both homes are owned by the same person. They are saying that it was an act of god, and they are not responsible. Help!!!!!

Re: damages and responsibilities

Apply under your own insurance.

If there was knowledge of a defective state of the roof,

there may be liability. Otherwise, if it really was "weird",

they may not be liable to you for your damages. That is what

carrying your own insurance is about.

Re: damages and responsibilities

They are right, unless you can show there was some negligence in the maintaining of the roof.
