Legal Question in Real Estate Law in California
my daughter worked for Home Depot as a cashier, she discovered 500 dollars in a tube one night and shared this information with another worker, who took the money, gave her 200 of it and kept 300. She gave him the 200 back, said she wanted nothing to do with it. the next morning she was called in and asked what happened, she told them, they then called the police, handcuffed her, escorted her out of the store to the local police station, then let her go. they told her that there were no charges filed so they couldn't keep her locked up. she then recvd a bill from a coll agency for $500. she called them told them she had no job and was unable to pay it in full, asked if she could pay what she could, as she got any monies. she recvd another bill the next month for $900. called them again, stating the same thing. now she receivd a notice to to appear for embezzelement and grand theft of personal property. what can she do? she still cannot find a job.
1 Answer from Attorneys
What she must do is appear in court as ordered. A public defender will be appointed. The public defender is a lawyer appointed to defend persons against criminal charges when they cannot afford to hire an attorney. After conferring with her public defender and their joint discussion about the police report, charges, and evidence (if any), your daughter and the public defender will need to decide whether to plead innocent or plea-bargain with the D.A. Based on the facts given, I'd say your daughter is factually innocent of embezzlement or grand theft, but then we only have her side of the story.
