Daycares using HOA property

According to our HOA lawyer that if an homeowner in our HOA has a daycare provider the children in that daycare are considered ''Family'' and that means they can use the common areas. Since Daycare providers are businesses then is the homeowner using the common areas for personal gain? Is against the CCR&? Also, what is the liability of the HOA should one of the children be hurt?

Once needs to review the CC&R's and the law regarding Day Care Centers, which are extensively regulated.
