Legal Question in Real Estate Law in California

Demand for Payment

I am submitting a Demand for Money Payment. Is there a legal timeline in which you have to give the Respondent? Like 30-days to respond, 7-days to respond?

Re: Demand for Payment

No, not unless you are making the demand under a contract that gives the debtor a certain time within which to cure a default. However, if you are anticipating having to sue because the debtor is less than likely to pay, your case will be somewhat stronger if you have given a reasonable time rather than a very short time. On the other hand, be aware of the statutes of limitations - four years from date of breach on a written contract, two years on an oral contract.
