Legal Question in Real Estate Law in California

Denied loan mod by Chase (our servicer) because I was not 60+days late. Was told for 9 months to keep making payments on time. Have never been late on my mortgage. Trying to get a 5/1 ARM due 1/2012 adjusted into a 30 yr fixed fully amortized. Currently unemployed but making payments. Not upside down, not asking for handout, looking to work with the 'owner' of my mortgage (Citibank bought it from Chase. The original mortgage was thru WAMU which was bought by Chase) and getting nowhere on all fronts. The runaround and lies Chase has fed me over the past year has been breathtaking! Any suggestions to save my family home are appreciated.

I remember reading this post earlier. I believe that Mr. McCormick pointed out that if Citibank held the note and deed of trust, that you should be negotiating with Citibank, and not Chase for a loan modification. I agree with his earlier response that you are negotiating with the wrong lender. You would only negotiate with the original lender if the assignment of the note was for security purposes only.
