Legal Question in Real Estate Law in California
Deposits and Fees
I moved to Arizona. My previous landlord has sent me notification that she is charging me $50 for light touch up and $100 for shampooing the carpet and $50.33 for an extra day for the 24th of march. We gave a proper 30 day notice and we moved out on the 22nd of march. We placed the keys in the drop box as instructed by the apartment manager when we left that night. I have called and she says I did not give a proper 30 days and that she should charge me for another two days and is not willing to waive the $50.33 for the 24th of march. She will not minimize the $100.00 for carpet cleaning. I feel that I am being taken advantage of. Can anyone help me? What can I do? I am willing to give them the 100 dollar deposit but I think it is very unfair to charge me the extra $100.00 dollars.

Re: Deposits and Fees
I suggest you file a small claims court action. If the Court finds that the landlord acted in bad faith, it can impose a $600.00 penalty under Civil Code Section 1950.5. You should addd the $600.00 in your complaint.
Re: Deposits and Fees
On exactly what day did you give your 30 day notice. The month of February is a short month, and you may have actually been 2 days short.
