Legal Question in Real Estate Law in California

Disclousure?

I am located in Little Rock CA.

Recently a friend of mine bought a house. It was not an advertised home for sale.He bought it because back taxes were over due and it was going to be going up for action.

After purchasing this house he started to remodel, he tore out all the windows and went to buy double pained windows. When he returned ther was a notice on the house to cese and desist.

When he inquired about the notice he was told that the 50 year grandfather clause had expired and he could not live in the house it was now zoned for commercial only.

So, my question to you is even though he bought this house as is. Dosen't that information have to be disclosed?

Also what should he do about this? The sellers were aware of this grandfather clause ending at the time they sold.

Thank you for you help in this matter,

Re: Disclousure?

Was the grandfather clause you're referring to recorded on the property's title?

Re: Disclousure?

You may have a case against the Seller. We would have to review your contract, title report, and disclosure documents. Your damages would be the difference between commercial and residential. Please contact our office if you have any more questions.
