if i have a dispute with neighbor regarding his encroahment of my property which has caused property damage, should I agree to go to mediation provided by county or take legal action instead?

It really depends on how familiar you are with the law and the implications of any settlement you may be inclined to agree to. Mediation is not binding, so you can still go to court if you do not reach a settlement. Depending on the circumstances, you may want to go to private mediation - it is not free, but some people have found certain county mediation programs to be overburdened, an thus less able to provide the level of attention some disputes require. You would do well to fully understand the law applicable to your dispute, and even if you don't want representation now, consider at least a complete evaluation by an attorney.
