Dog gets out
Our dogs got out of our six foot fence through a dislodged fence board. We were not home at the time. Our dogs are accused of killing a small doxie in the neighbors yard. The neighbors were breeding this dog to theirs. We did not no this incedent happened utill five days later when the animal control officer came to our door with a ticket. At that time we inspected the fence an discovered the dislodged fence board. The fence is nailed from our side and I told the animal control officer my dogs didn't come out here and pry this board loose. Further examination showed dog scratches from the neighbors side. They have a german shepard type dog that works the fence constantly. I know my dogs could have killed the little doxie if they got out of the fence after all they are animals. My question is am I responsible for this if their dog dislodged the fence board, that caused my dogs to get loose?

Cutting to the chase: If you have homeowner's or renter's insurance, submit the claim for compensation for the doxie to the insurer. Their attorney will deal with it. The insurer may or may not offer advice or help with the ticket.
You will be held liable if the trier of fact finds you were negligent. The damages you are liable for can be reduced if the owner of the german shepherd was also negligent.
