Legal Question in Real Estate Law in California

Easement Complaint

How do I formally file a complaint about a neighbor who will not keep their shrubbery from over growing onto the sidewalk, causing pedestrians to walk on the grass?

This is within city limits.

I agree with Mr. Berger, except I would go further.

I would send certified letters to both the city, and the neighbor, and notify both that you expect the problem to be corrected within seven days from the date of the letter. (Make sure you request return receipts).

Probably, you will get a response. I have found that, more often than not, a letter from an attorney produces more results than that sent by a private citizen, and most attorneys will do this for a very reasonable fee (usually 1/2 hour of their time).

Please feel free to e-mail, or call, my office, if you need more.

Re: Easement Complaint

Call the city. Tell the city it is a dangerous condition. Follow up with a letter, confirming that you advised the city of the dangerous condition by telephone on September X, 2007.

The city will probably take care of it.
