Legal Question in Real Estate Law in California
I have an easement over what is described as "the unsubdivided land". My neighbor claims that I became landlocked when the land was later subdivided? Is my neighbor correct?

If the easement was recorded and properly described, it survives the subdivision. Furthermore, if your property became landlocked, you are entitled to an "easement by necessity" as a matter of law. The law does not allow landlocked parcels unless they are owned by the same person.
