Eminent domain
A large government agency has decided to commence steps toward eventual eminent domain of our muti-acre property. This, even though this agency already has in its posession a completed enviromental review of a nearby site that provides them the mitigation measures to develop at the nearby site.
Does any precedent exist in eminent domain cases where, when more than one site has already been available with a completed EIR, agencies cannot just simply discard those older sites as they please, and try and enforce eminent domain wherever a cheaper alternative crops up?
