Legal Question in Real Estate Law in California

End Lease

I have a lease that still has about 5 months left. I just got approved for a home loan and asked the Landlord if I could break the lease if I gave a 30-60 day notice to vacate, what the penalty would be. She said that it had been $300-$500 to break but now it is $1,500. I currently pay $1325 and gave a $500 deposit. It does not state on my lease that I would have to pay this amount ($1,500). I know that lanlords have the right to any lost rent that they might encounter from a broken lease but if I give enough notice and someone occupies right after I leave why the large amount?

Re: End Lease

Most likely if this went to court you would be required to pay the lesser of $1,500 or the rent the landlord actually lost, or would have lost given a diligent attempt to find a new tenant.
