Legal Question in Real Estate Law in California

I�m currently in escrow. Escrow closing date is 4/14 and Listing agent has yet to provide termite report or seller disclosures. My lending agent won�t approve loan unless we get this information. I had already paid for a VA appraiser, Inspector and VA condo approval Attorney Option Letter all add up to $1300.00. The listing Agent is not returning phone calls or emails. Do I have the option to take the listing agent to small claims court to recoup my $1300.00 or is this money lost?

I still have $9600.00 tied up in escrow that should be given back since I have yet remove my loan contingences
