Depending on the reason, you have to give a three-day notice if for nonpayment of rent or violation of the terms of the lease, or 30- or 60-day notice if for any other reason. Some localities have rent stabilization laws that prevent evictions except for enumerated reasons.

If you do not have a lease in force and if the tenant is current, a 30 or 60 day notice is needed. If the tenant is behind, a 3 day notice to pay rent or quit can be served. After these steps, an unlawful detainer can be filed. Please call me if you need further assistance.
