evicting a tennant

I just bought a duplex in long beach,ca. I would like to evict one of the tennant to take back the unit. The tennant had money problem with the previous landlord(few years back). I just want the unit back to remodel and be able to increase the rent later(below market now). Tennant has been there over 5 yrs.

what's the best way to evict w/o complication.

My info shows that Long Beach doesn't have rent control, so the answer depends upon whether the tenant has a long-term lease or not.

If there is no lease, i.e. this is a month-to-month tenancy, you simply give 30 days' notice in writing. If the tenant has a long-term lease with time before it expires, you will either have to wait, or evict based upon a material breach.

If you are a new landlord and don't know these basic principles, I recommend you buy and read one of the self-help books on landlording or landlord-tenant relations. Nolo Press has a good one. Careful reading will save you big problems.
