Legal Question in Real Estate Law in California

eviction based upon income

My manager informed me that I am not eligible to reside at this residence, because my income is too high. My income has not change significantly since my lease was signed in Feb.1998. We are required to recertify annually. The previous manager never informed me that this was a problem. My rent is paid on time every month and I'm employed with the same company. The manager stated that the previous managers did not process my paperwork appropiately and she is the only one who has done it right, and my file is empty. No record of my employment and check stubs. However I have my ssssigned lease. Please help me. Can they make this an issue now?

Re: eviction based upon income

You are apparently living in a subsidized unit. Ask to see the new calculation of your qualification. If it is correct, then you probably do not qualify. The fact that a mistake was made in the past makes no difference. Remember that the taxpayers are paying your rent, and you have to accept the government's rules for your qualification.
