Legal Question in Real Estate Law in California

Eviction of Disabled Person

7 Yrs ago landlady rented to me illegally. Property not zoned for rental. Now being evicted. Am disabled/diabetes. Can I sue for back rent? And how do I do that and preserve my "tenant rights" with regard to the eviction process? Can I sue for discrimination against disabled person? No heat provided for last 7 years as req. by law. Power constantly failing = insulin & food spoiling in refer. Situation desperate! Help please!

Re: Eviction of Disabled Person

You can't sue for return of rent. You lived there and got the benefit of your bargain. If you had problems with the apartment you should make her fix them or move out.

You did not say why you were being evicted, your rights depend on the reasons. If you have not paid rent; of if you break the lease agreement your rights are limited to curing the problem in the time alloted.

Why would you choose to live in a place without heat for 7 years? Sounds like she is doing you a favor so you can get a good place to live.
