Legal Question in Real Estate Law in California

Eviction of mother from home

If someone's mother moved into her daughter's home 90 days ago with the verbal understanding that she would find a job to help defer costs (mortgage, food, etc.) and to this date she has not even attempted to look for work, has no money and is now causing problems for her daughter's family, can she be evicted? And what is the procedure?

Of course she can be evicted, a 30 day notice then an unlawful detainer action filed at your county courthouse.

If you really wish to have this person's mother removed from the house, check, as I recall Civil Code section 1945.6. This section provides that a notice given that is equal to the rental period must be given per the civil code provisions. If she has not moved out at the end of the notice period she can be arrested and removed.

I have not checked the code sections if they are wrong contact me by email, and I will find the correct code section.
