eviction

i run an inn/motel and have a guest that's been a resident for the last 8 months. he signed a lease agreement reg. day-to-day payment. guest is always 1-3 days late in rent and sometimes drunk. i have given him a letter/notice that we will not tolerate this mode of payment anymore. he caught with his payment but after 1 week is back to the same mode of late payment. what can i do to rid this guest from our establishment? does CA. law protecting tenant's right overule the signed lease agreement he signed with us? thanks in advance

Re: eviction

to give you a meaningful answer i would need to see the lease. Just give him a 3 day notice each time he is late. Note that once that 3 days passes you do not have to accept the rent and can evict him.
