Legal Question in Real Estate Law in California

Causes for eviction of a tenant

I am a tenant coming to the end of my one year lease. I am a Section 8 tenant. The onsite manager here has been extremely rude (bordering on harrassment) to me over silly issues. I didn't know he had an alcohol problem when I moved in. I would like to know where I can get information on my rights as a tenant and what causes they can use to evict me. I have always paid my rent on time, haven't made noise, etc., but I suspect he is trying to build a case for me to leave. Thank You.

Re: Causes for eviction of a tenant

You have a right to privacy which includes a right to be free from excessive harrassment. You may be able to get some relief by contacting someone in the management structure one step above the resident manager, or you may find a sympathetic ear at HUD, but that may not be the best route to relief because the bureaucracy tends to be a little deaf. I suggest documenting everything by keeping notes, etc. and finding a book on tenant's rights -- there are many -- at the library. The book will give you a sense of when the harrassment rises to a level where you have a good claim for invasion of privacy or some other remedy.

Good luck on your renewal; a positive factor is vacancies in rentals are becoming more numerous.

Generally, the two ways a section 8 tenant can be evicted is for non payment of rent or breach of some covenant. As long as you have not committed any of the above, you should be fine. Should you get an eviction notice, please fax me at (714) 363-0229 the notice and a copy of your lease and section 8 agreement. I will provide free consultation.
