Not an eviction, Terminating Tenancy

When renters state they wont leave after a 30 day notice is issued, but before the 30 days is up,what is the quickest legal step to get them out. must we wait the 30 days, or should we start eviction procedures? Do we have any legal recourse without the eviction process? What forms should we have prepared to take to court to insure an unlawful detainer, garnishment of wages,& sherrifs assistance, assuming we would win. How long could an eviction process take?

If the tenant paid the last months rent you would have to wait for the thirty days to run. There may be other factures that would allow you to terminate the tenancy early. The unlawful detainer law is strictly construed. Therefor it is easy to be thrown out of court forn non compliance. You should hire an attorney to represent you in this matter. Your house is far to valuable to take the risk of representing yourself. Unless you are prepared to put forth the effor th to learn how to do it.
