Legal Question in Real Estate Law in California
No explanation 30 day notice at a month to month apt
I've recently received a 30 day notice to vacate at a month to month lease apt. I called for an explanation and they say we violated a "no pets" clause by having fish tanks and that they have cause water damage. These fish tanks have existed for several years in plain sight and we never once were told of any problem. We are one of the last apts left paying a low rent because of the length of time we have lived there. Recently there have been many renovations to the apt and we suspect they want us out to make way for new higher paying tennants. We just signed a new lease recently also. I understand that no explanation need be provided at a month to month. Is there any recourse?

Re: No explanation 30 day notice at a month to month apt
If there is any recourse, it is probably due to some local rent control or stabilization ordinance. You should make local inquiry to find out whether your community has any such rules. Look in your phone book under city government for any departments with names that suggest they have something to do with rent control or tenants' rights. Or ask your friends and neighbors.
