how do I file a notice of default

i hold a Deed of Trust and Promissory Note and the borrower has not made any payments on this note dated January 3, 2007. I have sent him late notices demand for payments and now i need to file a notice of default PLEASE HELP

Hire a professional foreclosure service. These people are experienced in doing this. Hiring an attorney on a contingency fee would probably be much more expensive than the foreclosure service.

If your note provides that the prevailing party in any dispute is entitled to collect attorney's fees, you can probably get an attorney to handle it for you on a contingency basis. If you want to fax me the note, I'll take a look at it for free.

You hire a trustee to do it. Trustee's fees are set by statute and they are paid by the debtor.
