Legal Question in Real Estate Law in California
I filed a chapter 7 bk pro se to delay the sale of my home in forclosure as recommended by the law firm i retained who stated they could negotiate a modification (they were unsuccessful, my income was not enough for the modification and they do not do bankruptcys). My mortgage company has now filed a motion to revoke the stay. if they are successful in this motion, how fast to i have to vacate the home. i was told if the house was sold in auction, i would have 60 days because i have renters living with me. will the 60 days start from the time the motion to revoke the stay is granted or will they back date it to the original sale date and I have vacate immediatly. what are my options...I need time to move out as i have a disabled grandmother and son who i care for

I wonder whether you got ripped off by this law firm. I have never heard of a law firm that supposedly helps consumer debtors that would tell the client they do not do bankruptcies, or to file their own Chapter 7 in pro per. What is the name of this firm? How much did they charge you not to modify your mortgage? What did they promise to do for you? Do you have a copy of the retainer agreement? What is your Chapter 7 case number?
